Terms of use
Last updated: 10 September 2026
These terms of use (the "Terms") set the rules for accessing and using the Finamax website. They form the contract between the publisher of the Site and anyone who browses it or creates an account. This English text is a translation provided for convenience; the French version prevails.
1. Purpose
The Site provides, free of charge, an educational simulator for comparing the past performance of financial assets (indices, shares, ETFs, commodities, cryptocurrencies, currencies, rates) and illustrating investment scenarios from historical data, along with related calculation tools.
The publisher's identity and the host's details appear in the legal notice.
2. Acceptance
Browsing the Site constitutes full acceptance of these Terms. Anyone who does not agree with them must stop using the Site. Creating an account, where possible, requires explicit acceptance.
3. Nature of the service: no investment advice
Finamax is an educational simulation tool. It provides no investment advice, no personalised recommendation, no investment service within the meaning of article L. 321-1 of the French monetary and financial code, and no portfolio management service.
Simulations describe the past and have no predictive value: past performance is no guide to future performance. Any investment carries a risk of partial or total loss of capital. Decisions made by the user are their sole responsibility; they should consult a qualified professional before investing.
4. Displayed data
Quotes and historical series come from third-party providers and are then processed by the publisher. They are supplied as is, with no guarantee of accuracy, completeness, timeliness or continuity, and may contain errors, delays or interruptions.
The results shown ignore taxation, brokerage fees, management fees and execution slippage: they therefore do not reflect what a real investment would have produced. Any anomaly you notice can be reported through the contact page.
5. Access to the Site
Access is free of charge, apart from internet connection costs, which remain the user's responsibility. The publisher endeavours to keep the Site available without being bound to do so: it may be suspended, interrupted or altered at any time, in particular for maintenance, updates or technical reasons, without notice or compensation.
6. User account
User accounts are under development: this section applies once registration opens.
- Accounts may be created only by individuals aged 15 or over, acting personally and not for commercial purposes.
- The user provides a valid email address they control and undertakes to keep this information accurate.
- The account is strictly personal. The user is responsible for keeping their password confidential and for all activity carried out from their account; they must inform the publisher without delay of any unauthorised use.
- The display name shown on the leaderboard must not infringe the rights of others or the dignity of individuals; the publisher may replace or remove one that is manifestly inappropriate.
- The user may delete their account at any time. Doing so permanently removes the saved portfolios and the results published on the leaderboard.
- The publisher may suspend or close an account in the event of a breach of these Terms, after informing the user except in an emergency or where required by law.
7. Prohibited uses
The following are prohibited in particular:
- systematically extracting, reusing or reconstituting all or a substantial part of the Site's database, including through automated harvesting (scraping);
- accessing the Site's technical interfaces by automated means at a rate liable to disrupt its operation, or circumventing rate limits and anti-robot measures;
- attempting to gain unauthorised access to the administration area, to other users' accounts or to the underlying systems;
- sending unlawful, abusive, defamatory or unsolicited promotional content through the public forms;
- presenting the Site's content as financial advice, or redistributing it in a way that suggests endorsement by the publisher.
8. User-submitted content
The user remains responsible for the content they submit (messages, asset reports, display name). They warrant that they hold the necessary rights and undertake not to submit third parties' personal data.
By reporting an error or a missing asset, the user allows the publisher to use the information submitted to correct and extend the Site's catalogue, without consideration.
9. Intellectual property
The Site, its code, texts, visual identity and the organisation of its database are protected. These Terms grant only a personal, non-exclusive and non-transferable right of use, limited to browsing the Site. Rights and third-party licences are detailed in the legal notice.
10. Liability
The publisher cannot be held liable for investment decisions made after reading the Site, for any financial losses resulting from them, for errors or unavailability in data supplied by third parties, or for an interruption of the service.
Nor can it be held liable for indirect damages such as loss of opportunity, loss of profit or loss of data. None of these provisions excludes the publisher's liability in the event of gross negligence, wilful misconduct or personal injury, nor deprives a consumer of the rights granted to them by law.
11. Third-party links and services
The Site may link to third-party sites or load external resources (fonts, images). The publisher exercises no control over their content or practices and accepts no liability for them.
12. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these Terms.
13. Changes to the Terms
The publisher may amend these Terms to follow changes to the Site or to the law. The applicable version is the one published on this page, with the last-updated date shown at the top. In the event of a substantial change, account holders are informed by email; continued use constitutes acceptance.
14. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the user is invited to contact the publisher through the contact form in order to seek an amicable solution.
Where the publisher acts as a professional and the user is a consumer, the latter may refer the matter free of charge to a consumer mediator or to the European online dispute resolution platform. Failing an amicable settlement, the French courts have jurisdiction, without prejudice to the protective rules applicable to consumers.
